Judge Directs Private Hospital Care for Tigran Gambaryan Amid Health Concerns

In a dramatic turn of events, Justice Emeka Nwite of the Federal High Court in Abuja ordered that Tigran Gambaryan, a detained Binance executive, receive medical treatment in a private hospital. The directive followed Gambaryan’s collapse in court during proceedings on Thursday.

Justice Nwite instructed the correctional centre to take Gambaryan to Nizayime Hospital or any suitable facility within the jurisdiction, ensuring that adequate security is provided during his hospital stay.

The court session took an unexpected turn when Gambaryan, slated to continue his trial, did not step forward into the dock. Instead, he remained seated at the back of the courtroom, prompting the judge to inquire about his whereabouts. As Gambaryan, assisted by his lawyer, attempted to approach the dock, he collapsed and had to be seated in the front row.

Gambaryan’s lawyer, Mark Mordi (SAN), informed the court of his client’s serious health condition, filing a written application to notify the court. “My Lord, the case may not certainly proceed today,” Mordi stated, indicating that Gambaryan required immediate medical attention.

Throughout the proceeding, Gambaryan appeared visibly unwell, resting on the arm of his chair. Mordi sought a court order for Gambaryan’s treatment at Nizayime Hospital, emphasizing that prompt and appropriate medical care was crucial.

The counsel for the Economic and Financial Crimes Commission (EFCC), Ekele Iheanacho, did not oppose the need for medical treatment but questioned the specificity of Nizayime Hospital. Iheanacho argued that any capable hospital within jurisdiction should suffice, provided security measures were ensured.

Mordi countered by asserting the importance of a reliable medical facility for his client’s treatment, offering that the company would bear the costs. He stressed that Gambaryan’s health was critical for him to stand trial.

Justice Nwite, after considering arguments from both sides, ruled in favour of Mordi’s rephrased request. He ordered that Gambaryan be treated at Nizayime Hospital or any other appropriate hospital chosen by the correctional centre, with security guaranteed.

Additionally, the judge mandated the correctional service authority to provide a medical report from the recent examination conducted on Gambaryan to both the prosecution and defence counsel.

Gambaryan’s absence had previously stalled his arraignment on tax evasion charges filed by the Federal Inland Revenue Service, implicating him, his colleague Nadeem Anjarwalla (currently at large), and their firm Binance Holdings Limited. Justice Nwite had earlier denied Gambaryan’s bail application, citing the EFCC’s argument that he posed a flight risk similar to Anjarwalla.

Gambaryan, Anjarwalla, and Binance Holdings Limited face serious charges of money laundering and terrorism financing brought by the EFCC.
